Passenger Card Application Form

ARTICLE 1 - PARTIES:

Metro Turizm Seyahat Organizasyon A.Ş. which resides in Büyük İstanbul Otogarı B-2 Geçişi K:3 Bayrampaşa / İST. and the passenger whose name is ……………………………… and who resides in the address specified in the form enter into a membership agreement as per the following conditions.

ARTICLE 2 - DEFINITIONS:

Metro/Workplace	: Metro Turizm Seyahat Org. Ve Tic. A.Ş.,
Program	: The promotion program that is organized by METRO and gives the opportunity to the members to buy ticket with the points they have collected,
Web Sitesi	: www.metroturizm.com.tr website,
Card	: Metro Turizm Passenger Card which gives the opportunity to the members to collect points as they buy tickets and to buy tickets with the points they have collected,
Ticket point	: The point given on the basis of travel whose calculation unit is carried out for the program in return for passenger ticket bought by paying the price.
Member	: The passenger whose name and address is specified above and who benefits from the passenger card program.

ARTICLE 3 - SUBJECT OF THE AGREEMENT:

This agreement is issued to offer various advantages to the METRO passengers for preferring their company in their travels and regulates rights and responsibilities of the parties and terms of use of the METRO TURIZM PASSENGER CARD MEMBERSHIP program.

ARTICLE 4 - RIGHTS AND RESPONSIBILITIES OF MEMBER:

• The MEMBER accepts, declares and undertakes that all information provided for membership during the initial stage and later is correct and complete and the deliveries are carried out according to the information specified in the form. The MEMBER is liable to update the information in case the information declared in the form changes. The MEMBER is responsible for the errors that may arise due to not updating the information and the loss that may arise due to these errors.
• By signing the application form and this agreement, the conditions in this agreement are deemed to have been accepted.
• Even though the card owner does not sign the Card membership form, the card owner is deemed to have been accepted the campaign conditions specified by METRO and the general conditions of the Card Customer Loyalty Program with the initial use of the card beforehand.
• The MEMBER accepts that the information filled in the form can be used in marketing activities such as campaigns, invitations, mails, e-mails, SMS text messages determined and issued by METRO or third persons.
• Card membership is private and non-transferable.
• No fee shall be charged from the MEMBER to benefit from this program.
• Ownership of the Card belongs to METRO. The MEMBER accepts and declares that use and unauthorized quote of name and logo of METRO and the Card are forbidden.
• The MEMBER is liable to use the card in accordance with its intended use and to keep it in good condition. In the event that it is determined that the Card is not used in accordance with the conditions in the application form and the intended use of the card, METRO may demand the return of the card, retain the card and stop its use by canceling the card. Also, in case it is determined that the card is used unduly to earn income, METRO takes legal steps about the persons who use the card and/or the persons who allow the use of the card.
• In the event that confidential personal information is acquired by other third persons or hackers without gross negligence by METRO, METRO shall not have any responsibility.
• The MEMBERS may purchase their tickets with their personal member number provided by phone or company website of METRO without coming to the METRO terminals.
• The MEMBER may demand the points accumulated in the former card to be forwarded to the new card from the METRO card authorities in order to be able to forward his/her points gained with his/her former card to the new card. The MEMBER may ensure the forwarding provided that the information specified in the new card application form corresponds with the identity/personal information in the former application form. Errors arising from erratum are not binding.

• METRO determines the amount of Points to be gained with the use of the card on its own freely. When the points accumulated by calculating in this way correspond with the price of the free-of-charge trip requested, the MEMBER becomes entitled to receive free-of-charge ticket by using this amount. The MEMBER accepts and declares that the rules of METRO are valid in gaining points and turning the account into reward and when and in which routes the free-of-charge ticket will be used.
• The Points gained remain valid for a year. Points from before 365 days are not included in this calculation and are not used. Points that are not used for 365 days are deleted from the account as of the date of travel.
• Each MEMBER has a personal points account. Points shall not be transferred to the another MEMBER's account in any way.
• The amount which corresponds with the accumulated Points shall not be given in cash.
• After 2 days of each travel, the Point of the traveled course is added to the membership account.
• The MEMBER shall specify his/her Card member number as he/she makes a reservation and/or buys a ticket in order for the Point gained is recorded to the account correctly. While buying free-of-charge ticket by using points, identity card and/or driver's license must be shown with the card.
• The MEMBER may find out the Point gained from the METRO offices from which ticket sales service is provided and/or METRO website with his/her member number and password.
• METRO is the sole agent who will determine whether the MEMBER is entitled to the Point or not.
• This program only includes Domestic travels.
• The MEMBER accepts that he/she will carry out necessary transactions such as reservation and receiving the ticket required to be carried out in relation to the use of free-of-charge tickets gained before METRO. METRO offices from which ticket sales service is provided are the sole authority to give the free-of-charge tickets gained. If the MEMBER makes the reservation related to the travel without specifying the Point reward request explicitly, METRO may deny giving the reward.
• The rewards are subjected to date and specific quota limitations specified by METRO and other limitations stipulated by the legislation, especially Road Transport Regulation, including the rule regarding the fact that "maximum 1 passenger may be transported each time".
• Free-of-charge tickets gained are only issued on behalf of the MEMBER who is the PASSENGER CARD owner. In the event that the free-of-charge ticket issued is canceled by the MEMBER at least 2 hours before the departure time, the ticket may be canceled and the Point spent is restored to the MEMBER's account.
• In return for cancellation and return of the free-of-charge ticket, METRO shall not make payment to be MEMBER.
• METRO shall not accept any responsibility in relation to taxes and fees the members and third persons are subjected to regarding the rewards gained from METRO TURIZM PASSENGER CARD program.
• Points shall be reset in case of card cancellation. No right is claimed retrospectively.
• Even though the member is active, it can be reset by notifying the member beforehand.

ARTICLE 6 - GENERAL CONDITIONS:

• METRO has the right to apply partial or full amendment or remove this program and application principles unilaterally without notifying the MEMBER. MEMBER makes no request in such case from METRO. METRO does not guarantee the issues that the rewards it will grant within the frame of the program shall be consistently available, that always the same reward will be won for the same amount of Point and that the MEMBER can always use the reward on the route and trip he/she demands. This program does not mean that METRO has a certain warranty and liability and it shall be applied according to METRO's trip program, work and activity plan as long as it has availability.
• Supposing that METRO detects that the METRO TURIZM PASSENGER CARD Member acts contrary to the terms defined in PASSENGER CARD MEMBERSHIP AGREEMENT partially or completely in any way and form, METRO has the right to demand the compensation for all kinds of damage and loss it was exposed for that matter from the member as well as it may terminate the membership and consider the point and rewards the MEMBER collected as invalid.

ARTICLE 7 - INCIDENT OF CARD'S BEING STOLEN, LOST OR DAMAGED:

In case of a card being stolen, lost or non-functioning, the MEMBER shall notify the case to METRO immediately and cancel the Card. Card owner MEMBER is responsible from all kinds of damage until a notice is sent. The card shall be changed within 15 (fifteen) days at the latest by METRO or a new Card shall be given to the MEMBER.

ARTICLE 8 - TERMINATION OF MEMBERSHIP:

• METRO always reserves the right to terminate the agreement relationship with MEMBER. In the cases of the following issues, membership shall be terminated automatically.
  • MEMBER's failing to comply with these General Rules and Conditions,
  • MEMBER’s providing wrong information,
  • MEMBER’s not gaining any point from the program in 2 successive years.
  • Abolishment of the program with any reason,
  • All justifications based on METRO's unilateral discretion and determination,
• In the event of termination of the membership due to above reasons and all other reasons considered necessary by METRO, METRO has no obligations regarding the gained points of the MEMBER or any other obligations.
• MEMBER accepts and undertakes in advance that they shall not demand any compensation, any debt, and any right from METRO in the event of alteration, nullification, and abolition of PASSENGER CARD application, alteration of the standards or scoring of the reward system and other reasons.

ARTICLE 9 - TERMINATION OF AGREEMENT :

Agreement may be terminated without requiring any warning with the expiration of the membership or with the realization of either of the dissolution of cases by law, and also, the Agreement may always be terminated unilaterally by Card.
Even though the provisions of the agreement shall be automatically terminated in the event of the termination of the agreement, the provisions of the agreement which imply that they also cover the period after the termination (for example; matters regarding the obligations of the members and as such...) shall survive even after the termination.

ARTICLE 10 - RESOLUTION OF CONFLICTS:

Istanbul Central Courts and Enforcement Offices settle the disputes that may arise from hereby agreement.

Member declares, acknowledges and undertakes that he/she has read, understood and accepted all the articles of the membership agreement composed of these two (2) pages, and that he/she has confirmed the authenticity of the information provided.

Hereby agreement is contracted between the Card and ........................................................................ on the date of ........ / ........ / ............., with reciprocal declaration of intent of the parties.
